Business methods - potentially patentable in the USA

A long-awaited decision from the US Supreme Court has indicated that patents for certain types of business methods may still be granted in the US.  Historically, the US Patent Office has been considerably more lenient than the UK and European offices in terms of granting patents for business method-based inventions.  Some observers had feared that the US Supreme Court would decide that business methods are "categorically unpatentable", but this was not the outcome.  There is therefore still scope to patent business methods, particularly ones that involve software or other technical elements in their implementation, in the USA - and some other countries - and we are happy to advise clients on a case-by-case basis.
