We regularly see the same problem: entrepreneurs, start-ups and micro-businesses have innovative ideas worth protecting, but the cost of preparing a patent application can put protection out of reach at the very stage they need it the most.

For many businesses, that creates a frustrating circle. They need to protect their innovation to secure investment, grants or other funding, but need that funding to afford the cost of protecting it.

This is the gap we designed our new Pioneer’s Platform to address: an AI-assisted, low-cost, fixed fee UK patent application service, delivered under the supervision of qualified and experienced patent attorneys.

It has been designed specifically for entrepreneurs, innovators, start-ups and micro-businesses that want a cost-effective route to filing an initial UK patent application while retaining the oversight and expertise of a qualified patent attorney.

AI-assisted: The Pioneer’s Platform uses specialist AI drafting software to improve efficiency and reduce drafting time. Technical information supplied by the inventor is used within our AI-assisted drafting process, with the complete patent application reviewed, amended as necessary and settled by a qualified patent attorney before filing.

The AI software operates within a secure, closed system designed to protect the confidentiality of our clients’ innovations. Every application remains subject to professional attorney oversight, giving our clients reassurance and peace of mind.

Fixed fee: The Pioneer’s Platform is provided for a fixed professional fee for the work included in the service, helping clients understand and control the cost of preparing and filing their initial UK patent application from the outset.

Lower-cost route: By combining appropriate use of AI technology with the expertise of our patent attorneys, the Pioneer’s Platform enables eligible innovators to access patent drafting and filing at a substantially lower cost than our standard patent drafting service.

Additional costs arising after filing, official fees and work outside the scope of the Pioneer’s Platform are not included in the fixed Service Fee.

Some technologies and inventions may not be suitable for AI-assisted patent drafting.

Curiouser and Curiouser - Final Thoughts and Impacts

Last year, the EPO’s Enlarged Board of Appeal (EBA) completely overturned the general approach that the EPO had taken for decades in interpreting patent claims. Instead of insisting that the claims must be inherently clear and interpreted without reference to the description, in decision G1/24 the EBA decided that the description and drawings must always be ‘consulted’ to interpret the claims- and certainly when assessing patentability. Unsurprisingly, significant uncertainty remains as to how G 1/24 is to be applied in practice. That uncertainty has already led to a further referral, G 1/26, which seeks clarification on a number of important issues arising from the decision. In this article, we examine the questions referred to in G1/26. We also consider the potential potential consequences of the EBA’s answers for different parties.
