From 1 August 2026, Jersey will become an independent designation under the Madrid System, introducing an important change for brand owners seeking international trade mark protection.
Until now, protection in Jersey was automatically secured through a UK designation. Going forward, applicants will need to designate Jersey separately when filing a new international application, subsequent designation or renewal. Applicants will also be required to confirm their intention to use the trade mark in Jersey in relation to the goods and services covered by the application.
For existing international registrations that designated the UK before 1 August 2026, WIPO will generally record a Jersey designation automatically, with UK and Jersey rights then operating independently.
The change highlights the importance of reviewing international trade mark filing and renewal strategies to ensure that protection continues to align with applicants’ commercial objectives across both the UK and Jersey.
